Continuing our subject from 2 days ago, the Judiciary Power in this country, mainly the Supreme Federal Court, is also scared shitless of the mob.
In fact, we are pretty much living under mob rule, to the distaste of Alexander Hamilton.
There is no rule of the law. The law is only enforced in a few special occasions, and sometimes not even by those officially entitled to do so: when the mob demands it, when the rich and powerful demand it and when a court or a judge believes, from the bottom of their heart, that their personal feelings are aligned with the best interests of the nation.
Why do we have laws, judges and law schools, then? They maintain their status on pure authority, actually. Also, people are slow to figure out they don’t need judges like the ones we have (which are the most expensive in the world, let’s not forget).
If the Supreme Court is there just to answer the “demands of the people” (throwing all the counter-majority doctrine in the trash), if laws and the Constitution can be disregarded at will, when an un-elected authority feels things should be different, then the people could just save on judges’ salaries and decide what’s best for themselves.
It appears we waste 5 years in law school just to learn the Supreme Court will dictate new rules on each case (especially the ones involving politics and public spending), based on “the will of the people”, or what they think is “the will of the people”.
On the other hand, there is an increasing number of women getting killed by husbands or former companions who were put out of jail by these same judges and courts, or who were under restraining orders which had no means whatsoever of being enforced. Sometimes they kill their children too.
Those single moments in life where law-abiding, tax-paying citizens needed the Judiciary the most, namely to preserve their very lives, it failed them. So what good is our Judiciary, aside from consuming our money on the highest salaries on Earth?
